The regulatory framework of the Energy and Climate Law

The Energy-Climate Act of November 2019 is an important text for French regulations, as it sets the objective of carbon neutrality by 2050, which is a response to the climate emergency and the Paris Agreement.

More broadly, it aims to accelerate the energy transition and combat climate change in France by taking action in four main areas:

  • the gradual phase-out of fossil fuels and the development of renewable energies;
  • the fight against “thermal flats”;
  • the introduction of new tools for steering, governing and assessing climate policy;
  • regulation of the electricity and gas sector.

For businesses and local authorities, this law implies measures to reduce their carbon footprint and promote renewable energies, in particular solar power.

The French urban planning code has been amended to make it compulsory for new buildings over 1,000 sq. m. in size intended for commercial, industrial or craft use, or for covered public parking, to be fitted with vegetation or renewable energy production. It is required that 30% of the surface area of their rooftops or newly-created parking lot shade structures be dedicated to the installation of solar panels.
